The ugly truth is you can be not at fault in any way but sued and made to pay lawyers bills for defense expenses, time to testify and deal with the suit without any recourse to recoup payment. A business we had insured was sued with one of these frivolus lawsuits and even though there were many reasons it should not have gone forward it did. Finally it was settled, without any fault attributed to the owner. but the business owner still had many out of pocket expenses that cost his insurance company about $80,000.
